<h2>CODE OF ETHICS &amp; CONDUCT</h2>
<h3>Preamble</h3>
<p>The   buying, selling, ownership, and management of real estate are highly   regulated segments of our free enterprise system in the United States.  As   such, the member of the Greater Dayton Real Estate Investors   Association (GDREIA) must treat this enterprise with the utmost   professionalism.</p>
<p>GDREIA   membership includes each member in an organization of people who are   intent upon expanding their knowledge of real estate investing and   management.  In order to pursue these activities   in a legal and ethical manner, all members of GDREIA will be held to a   higher standard of ethical behavior.  This includes, but is not limited to, the following list of behaviors.</p>
<h3><strong>Therefore, all members of GDREIA shall:</strong></h3>
<ol>
<li> Conduct themselves professionally, with the highest level of integrity, accuracy, fairness, and responsibility to the public;</li>
<li> Not   represent conflicting or competing interests in their investing or   management activities, or when this is unavoidable, there must be full   disclosure to all parties involved;</li>
<li>Not take unfair advantage or malign other members, property owners or residents;</li>
<li> Not engage in or tolerate other members engaging in illegal practices of any nature;</li>
<li> Comply   with all applicable local, state, and federal laws, including housing   code standards for health, safety, and habitability;</li>
<li> Not   discriminate against any person on the basis of race, age, religion,   creed, sex, country of national origin, children, marital status, or   disability;</li>
<li> Not   place themselves in such a position where their interests may be in   conflict, or appear to be in conflict, with the good of the   organization;</li>
<li> Not intentionally communicate false or misleading information which may compromise the integrity of the organization;</li>
<li> Not   use the GDREIA logo, or other identification material or slogans,   without the express written permission of the Board of Trustees.</li>
<li>Not   make any unauthorized representations to the public, press or media   with regards to GDREIA’s position on any matter, and not represent any   legislative or political position as though it is that of the   organization, without Board approval.</li>
<li>Endeavor to promote GDREIA in its positive image within the community, and to aid and assist in the organization’s growth.</li>
</ol>
<p><em>Those   who want GDREIA to take action against a member for what they perceive   to be unethical behavior must present their case to the Ethics and   Grievance Committee in accordance with the instructions presented in the   bylaws.  The Committee will submit their   recommendation to the Board of Directors, who may then impose sanctions   as presented in the bylaws.  Such actions may include, but not be limited to, suspension or permanent expulsion from the organization.</em></p>

			<content:encoded><![CDATA[<h2>Ohio Professional Housing Provider (O.P.H.P.)</h2>
<p><strong>What is the OPHP designation?</strong> The OPHP designation   is a statewide, education-based certification program designed to   recognize the high level of knowledge and professionalism among the   designation holder. It is sponsored and overseen by the Ohio Real Estate   Investor’s Association (OREIA).</p>
<p><strong>Why obtain the OPHP designation?</strong> Only persons   completing the educational requirements will be permitted to hold   themselves out to the public as an Ohio Professional Housing Provider.   The designee will be recognized in the form of an award certificate and   the right to use the designation, and should recognize that having a   basic education in the topics outlined below will increase his or her   ability to reach his goals in real estate investment. Further, as OREIA   works to make the OPHP designation more recognizable, it is hoped that   the OPHP holders will have an advantage in dealing with legal and   governmental bodies when a “my word against his” situation occurs. It   will also aid in encouraging legislators to think of educated investors   as a larger group for political action. Other tangible benefits,   including discounts on courses and educational materials, may be added   as the program develops.</p>
<p><strong>Course of study.</strong> The course of study will be divided   into 42 clock hours of core courses and 18 hours of elective topics for   a total of 60 hours of formal education. The core topics are as   follows:</p>

<td>Including enacting and actual use of, national, state, local, and persona business ethics statements, policies and practices.</td>
</tr>

<td><strong>Fair housing law</strong></td>

<td>Including federal, state, and local fair housing regulations</td>
</tr>
<tr valign="top">
<td><strong>Finance</strong></td>
<td>6 hours</td>
<td>Including conventional financing, FHA/VA financing, owner financing of all types; comparing, financing, offering financing.</td>

<p>Federal regulations (1 hour): Including regulations   affecting real estate investment other than tax laws, fair housing laws,   and EPA regulations.</p>
<p>Local (2 hours): Including zoning and building codes.</td>

<td>2 hours</td>
<td>Income (1 hour): Including calculating and minimizing taxes, and tax laws as they affect the real estate investor.</p>
<p>Other (1 hour): Including property taxes, 1031 tax deferred trades, etc.</td>

<p>The remaining 18 hours may include further education in any or all of the above topics, as selected by the OPHP candidate.</p>
<p><strong>How will I obtain these hours?</strong> These hours may be   obtained through local association meetings and seminars. Or through   courses taught outside of the local groups. All outside courses and   seminars must meet the following requirements they must be taught live;   they must be pre-approved by the OPHP committee; and they must provide a   certificate of attendance acceptable to the OPHP committee.</p>
<p><strong>Continuing education to maintain OPHP designation.</strong> Once the OPHP designation has been obtained, designees must complete 20   hours of continuing education every two years in order to maintain the   designation. These hours are elective and may be used by the designee to   continue his or her education as he sees fit.</p>

<p>The $55.7 billion two-year state budget plan has been passed by the Senate and, after the Senate changes were rejected by the House, will now enter conference committee where members of both chambers will convene to resolve the differences. The points of contention must be resolved by the end of the month as the Ohio Constitution requires state lawmakers to have a budget bill signed into law by July 1<sup>st</sup>.</p>
<p>&nbsp;</p>
<p>Offering some relief to the budget woes are reports by the Office of Budget and Management showing overall tax revenues exceeding original estimates by nearly $1 billion. OBM Director Tim Keen has indicated that the additional revenues should be used to pay off certain Medicaid expenses and other costs that had previously been set to lapse into FY 2012. Governor John Kasich has stated that if revenues continue to come in ahead of projections, he plans to give the surplus funds back to the taxpayers in the form of a tax cut of some type.  However, members of the General Assembly are skeptical of this plan and may want to direct any excess dollars into the Budget Stabilization Fund “rainy day fund”.</p>
<p>&nbsp;</p>
<p>Items included in House Bill 153, the budget bill, are a provision that would eliminate the Estate Tax in Ohio on January 1, 2013.   Additionally, the Department of Commerce, Division of Real Estate is seeking to make changes to the real estate license law.  The changes include:</p>
<p>&nbsp;</p>
<ul>
<li>Clarify activities for which a license is required.</li>
<li>Clarify licensure exemptions.</li>
<li>Revise advertising regulations to accurately reflect Division policy.</li>
<li>Clarify payment of commissions.</li>
<li>

<p>Limit terms of Ohio Real Estate Commissioners to two consecutive terms.</li>
</ul>

<li>Exemptions such as the       trustee exemption and exemption for persons who own any interest in the       real estate, even an option.        Limiting exemption to the legal interest to eliminate the abuse of       this exemption.</li>
</ul>
</li>
</ul>

<ul>
<li>Advertising real estate       is a primary component to listing real state.  The current advertising regulations are       poorly written and do not comport with current industry practices and the       historical and current interpretation of the statute.</li>
</ul>
</li>
</ul>
<ul>
<li>
<ul>
<li>Current statute       technically prohibits the payment of commissions to salespersons who       retire or voluntarily place their license in inactive status after that       licensee earns the commission but before the transaction closes.</li>
<li>Codify the Division’s       position (upheld by case law) that interests in a commission may not be       assigned by a salesperson to a third party.</li>
</ul>
</li>
<li>Provide authority to the      Superintendent to issue advisory letters in lieu of initiating      disciplinary proceedings for infractions that require attention and      corrective action but don’t rise to level of formal discipline. No harm to      consumer, business or another licensee are examples of advisory letter use.</li>
</ul>
<ul>
<li>
<ul>
<li>There is currently no       limit. This revision mirrors the term limits in ORC 4763, the real estate       appraiser regulation.</li>
</ul>
</li>
</ul>
<ul>
<li>Provide the Ohio Real Estate Commission the authority to promulgate rules setting forth the curriculum of the 10 hour post licensure course.</li>
<li>Modify the disposition of fees received by the Division to increase funds in the operating account without raising fees.</li>
<li>Clarifies what constitutes the “date of licensure”.</li>
<li>Clarifies that a broker licensed in Ohio must maintain a definite place of business in the state.</li>
<li>Requires electronic notification to the licensee upon successful license renewal.</li>
<li>Establish that a licensee is not liable for “imputed knowledge” of another current or former licensee.</li>
<li>Prohibits a licensee from participating in a dual agency situation where that licensee is also a party to the transaction.</li>
<li>Clarifies the medical extension under continuing education requirements.</li>
<li>Revise the statute regarding investigations for unlicensed activity to remove the exemption for previously licensed individuals and to provide due process via 119 hearing process.</li>
<li>Adds disclosure of purchase contract information to a credentialed appraiser solely for purposes of performing a real estate appraisal to the list of exceptions to the confidentiality requirement.</li>
<li>General grammatical clean up.</li>
</ul>
<p>&nbsp;</p>
<p>Finally, there are also changes to the process for delinquent tax certificates.  The bill authorizes county treasurers to establish the time, between three years and six years after the date of sale or transfer of a tax certificate, within which a tax certificate holder must initiate a foreclosure action to collect the taxes. It further authorizes the negotiated sale of tax certificates in accordance with the requirements for current sales at public auction and authorizes tax certificates being sold at public auction to be advertised electronically.</p>
<p>&nbsp;</p>
<p>In separate news, the U.S. Department of Housing and Urban Development awarded the Ohio Department of Health a grant of $2.1 million to identify and remediate hazards from lead paint in low-income houses in 36 counties. The Ohio Department of Health will administer the funds in 30 Appalachian counties as well as six northwestern Ohio counties. Although the manufacture of paint with lead has been banned since 1978, 457 cases of lead poisoning were diagnosed in children age 6 or younger in Ohio in 2009.</p>
